1. Acceptance of Terms

By downloading, installing, or using the NavLog application ("the App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

NavLog is operated by Hakatere Helicopters Ltd ("we", "us", or "our"). These Terms govern your use of the NavLog mobile application and all related services.

2. Description of Service

NavLog is a marine voyage logbook application that provides:

  • Real-time GPS position tracking and logging during voyages.
  • Recording of speed, heading, and fuel consumption data.
  • Storage and retrieval of voyage history.
  • Passage planning tools including route creation, estimated journey times, and fuel projections.
  • The ability to attach photos and videos captured by your device camera to voyage log entries.

3. Account Registration

To use NavLog, you must create an account using a valid email address. You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activity that occurs under your account.
  • Notifying us immediately of any unauthorised use of your account.

You must be at least 13 years of age to create an account.

4. Important Safety Disclaimer

NavLog is a logbook and planning aid only. It is not a substitute for proper nautical charts, official navigation equipment, or qualified seamanship.

  • Passage plans generated by NavLog are estimates based on the data you provide. Actual voyage times and fuel consumption may vary significantly due to weather, currents, sea state, and vessel condition.
  • You must always carry appropriate charts, navigation equipment, and safety gear as required by maritime law and good seamanship practice.
  • NavLog does not provide real-time weather, hazard, or safety information.
  • All decisions relating to navigation, vessel operation, and the safety of persons on board remain solely your responsibility as the skipper or vessel operator.

5. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose.
  • Attempt to gain unauthorised access to any part of the App or its infrastructure.
  • Reverse engineer, decompile, or disassemble the App.
  • Use the App to store or transmit malicious code.
  • Resell or commercially exploit the App or its data without our written permission.

6. Camera, Photos, and Video

NavLog allows you to attach photos and videos to your voyage log entries using your device's camera or photo library. By using this feature, you agree to the following:

  • Camera and media access: The App will request permission to access your device camera and photo library. You may grant or revoke this permission at any time through your device settings. Revoking permission will disable the media attachment feature.
  • Your content: You retain full ownership of any photos and videos you upload. By uploading media to NavLog, you grant us a limited licence to store and display that content solely for the purpose of providing the service to you.
  • Acceptable content: You must not upload content that is unlawful, offensive, defamatory, or infringes the intellectual property rights of any third party. We reserve the right to remove content that violates these Terms.
  • Storage: Media files are stored securely in your account. Large media files may count toward any storage limits applicable to your subscription tier.
  • Deletion: You may delete any media you have uploaded at any time. Upon account closure, all media files associated with your account will be permanently deleted.

7. Your Data and Data Infrastructure

You retain ownership of the voyage data, passage plans, and media you create in NavLog. By using the App, you grant us a limited licence to store, process, and back up your data for the purpose of providing the service to you. We will not use your data for advertising or sell it to third parties.

NavLog uses Supabase as its backend data infrastructure for secure storage of your account information, voyage logs, passage plans, GPS tracks, and media files. Supabase is a trusted, SOC 2 compliant data platform. Your data is stored in accordance with Supabase's security standards. For more information, visit supabase.com/security.

9. Intellectual Property

The NavLog application, including its design, code, and content, is owned by Hakatere Helicopters Ltd and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the App on your personal devices for personal or commercial marine logbook purposes.

10. Subscriptions and Payments

NavLog may offer free and paid subscription tiers. Paid subscriptions are billed through the Apple App Store in accordance with Apple's payment terms. Refunds are handled in accordance with Apple's refund policy. We reserve the right to change subscription pricing with reasonable notice.

11. Limitation of Liability

To the fullest extent permitted by law, Hakatere Helicopters Ltd shall not be liable for:

  • Any loss of life, injury, or damage to property arising from reliance on NavLog for navigation or voyage decisions.
  • Loss of data due to technical failure, provided we have taken reasonable steps to maintain data integrity.
  • Any indirect, incidental, special, or consequential damages arising from your use of the App.
  • Inaccuracies in GPS data, fuel estimates, or passage plan calculations.

Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid for the App in the 12 months preceding the claim.

12. Availability and Updates

We aim to keep NavLog available at all times but do not guarantee uninterrupted service. We may update, modify, or discontinue features of the App at any time. We will endeavour to notify users of significant changes.

13. Termination

We may suspend or terminate your account if you breach these Terms. You may close your account at any time through the App settings. Upon termination, your right to use the App ceases and we will delete your data in accordance with our Privacy Policy.

14. Governing Law

These Terms are governed by the laws of New Zealand. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of New Zealand.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via the App or by email. Continued use of NavLog after changes take effect constitutes your acceptance of the updated Terms.
